Why searches and property checks are so important in a property transaction

Conveyancing searches are an important part of any property purchase process in Queensland. These searches provide buyers with valuable information about the property they are contracted to purchase, including any potential risks or issues that may affect the property’s value or their ability to use it in the way they intend. 

As a buyer, not going through the search process effectively, or fast enough, can leave you in a vulnerable position – timing is everything! It is essential that when a buyer decides a property is the one for them, that searches are conducted ASAP. It is wise to conduct searches prior to signing the contract or include a condition in the contract to make it conditional upon the relevant searches if you have concerns.  In Queensland, you have a 5-business day cooling off period, in which time searches can also be conducted.  

A title search is the foundation of property due diligence in Queensland. It reveals critical details about the property, including:

  • Current ownership information
  • Property description and boundaries
  • Registered mortgages or encumbrances
  • Easements and covenants
  • Caveats on the title

What other searches may be necessary?

Council searches may include: 

  • Building approvals and certificates – does the dwelling and any additions have final approvals?  
  • Outstanding rates/charges 
  • Zoning and land use restrictions 
  • Flood risk assessment

Environmental searches may include: 

  • Contaminated land status
  • Coastal erosion
  • Protected vegetation or wildlife habitats 
  • Bushfire prone areas 

Water searches may include: 

  • Water supply and sewerage connections/charges 
  • Water allocations and bore licences (particularly important for rural properties)
